Collegium Recommends New Chief Justices For 5 High Courts

The Supreme Court Collegium has recommended the appointment of new Chief Justices for the High Courts of Punjab and Haryana, Rajasthan, Allahabad, Gauhati, and Jharkhand. The Collegium, comprising Chief Justice of India DY Chandrachud and Justices Sanjeev Khanna and BR Gavai, passed the resolutions on December 27, which were uploaded on the official website on Thursday evening.

Justice Sheel Nagu, judge of the Madhya Pradesh High Court, has been recommended for appointment as Chief Justice of the Punjab and Haryana High Court. Justice Nagu was appointed as a Judge of the High Court of Madhya Pradesh in May 2011 and has been functioning there since then. Before his elevation as the judge, he practised at the High Court of Madhya Pradesh in constitutional, service, labour and criminal cases. The SC Collegium noted that “during his tenure of over 12 years as a Judge of the Madhya Pradesh High Court, he has authored more than 499 reported judgments”. “He has acquired extensive experience in dispensing justice at the High Court.

He is the seniormost puisne Judge in his parent High Court. He is considered to be a competent judge and possesses a high level of integrity and conduct required of a person holding high judicial office,” it added. The Collegium further recommended Justice Manindra Mohan Shrivastava, judge of the Rajasthan High Court, for appointment as Chief Justice of the Rajasthan High Court. Justice Shrivastava is presently functioning as Acting Chief Justice of the Rajasthan High Court and was appointed as a judge of the Chhattisgarh High Court in December 2009. Before his elevation as the judge, he practised at the Raigarh district court and High Courts of Madhya Pradesh and Chhattisgarh. His area of practice was constitutional, service, taxation, labour, civil and criminal cases and he specialised in constitutional, taxation and service law. The SC Collegium noted that “during his tenure of over 14 years as a Judge of the High Court, he has authored more than 505 reported judgments”.

“He has acquired considerable experience of dispensing justice in two High Courts,” it added. Justice Arun Bhansali, judge of the Rajasthan High Court, has been recommended for appointment as Chief Justice of the Allahabad High Court. Justice Bhansali was appointed as a Judge of the Rajasthan High Court in January 2013 and has been functioning there as a senior puisne Judge. Before his elevation as the judge, he practised at the Jodhpur bench of the Rajasthan HC in civil, company, Constitutional and taxation cases.

The SC Collegium noted that “during his tenure of nearly eleven years as a Judge of the High Court, he has authored more than 1,230 reported judgments”. “He has acquired extensive experience in dispensing justice in the Rajasthan High Court. He is considered to be a competent judge with sound legal acumen and, would therefore be an eminently suitable choice to be elevated as Chief Justice of the largest High Court in the country,” it added. Another Collegium resolution recommended Justice Vijay Bishnoi, judge of the Rajasthan High Court, for appointment as Chief Justice of the Gauhati High Court.

Justice Bishnoi was appointed as a Judge of the Rajasthan High Court in January 2013 and has been functioning there as a senior puisne Judge. Before his elevation as the judge, he practised at the Rajasthan High Court and the Central Administrative Tribunal at Jodhpur and dealt with civil, criminal, constitutional, service, and election cases. The SC Collegium noted that “during his tenure of nearly eleven years as a Judge of High Court, he has authored 652 reported judgments”. “He has acquired extensive experience in dispensing justice in the Rajasthan High Court. He has maintained a high order of professional ethics at the Bar and the Bench and his conduct and integrity are beyond reproach,” it added. It also recommended Justice BR Sarangi, judge of the Orissa High Court, for appointment as Chief Justice of the Jharkhand High Court. Justice Sarangi was elevated as a Judge of the Orissa High Court in June 2013 after completing 27 years of regular practice at the Bar before the High Court and the Supreme Court. The SC Collegium noted that “during his tenure of more than 10 years as a Judge of High Court, he has authored more than 1,056 reported judgments”. “He has acquired considerable experience in dispensing justice in the High Court…While making the recommendation, the Collegium has duly taken note of seniority of Judges of the High Court of Orissa,” it added.

Kerala HC recommends inclusion of sex education in curriculum

The Court has called for the constitution of a committee, if necessary, to study the issue of including “safe sex education” in the curriculum of schools and colleges…reports Asian Lite News

The Kerala High Court has urged the state government to look into the need for including safe sex education in the curriculum of schools and colleges.

The Court made the observation while disposing of a petition filed by a man to medically terminate the pregnancy of his minor daughter who was impregnated by her own brother.

 “Nobody can blame the parents. But we the society are responsible for this. Sibling incest may occur in a family system that does not provide a safe environment for its members. But it may also happen because of the lack of knowledge about safe sex. I am of the considered opinion that the Government should seriously think about the necessity of proper ‘sex education’ in schools and colleges  A good family atmosphere is necessary for the society. To attain this, every citizen of this country should join together without pelting stones at such unfortunate people,” read the judgment and asked to see that a copy of the judgment be send to the Chief Secretary of the state.

The Court has called for the constitution of a committee, if necessary, to study the issue of including “safe sex education” in the curriculum of schools and colleges.

Earlier, the Court had allowed the medical termination of the minor girl’s seventh-month pregnancy, but later it was told that the minor girl had delivered a child.

Following which,  the court directed the Child Welfare Committee to take a decision on the custody of the 

newborn in accordance with the Juvenile Justice Act.

The Child Welfare Committee later informed the court that the baby was surrendered to them and the minor l handed over to her uncle.

 “In light of the above orders, I think no further order is necessary. The Child Welfare Committee will take necessary consequential steps in accordance with the law. The protection of the newborn child is the duty of the state. These types of causalities shall not be there in our society in the future. The embarrassment of the parents and the victim girl cannot be imagined,” the Court pointed out.

Collegium clears 16 names for judges of Bombay, Madras HC

The top court collegium approved the proposal for appointment of Justice Ahanthem Bimol Singh, additional judge of the Manipur High Court, as permanent judge of that high court….reports Asian Lite News

The Supreme Court Collegium, headed by Chief Justice N.V. Ramana, has recommended the appointment of 10 advocates as judges to the Bombay High Court and six advocates as judges to the Madras High Court.

A statement published on the website of the top court said: “The Supreme Court Collegium in its meeting held on 16th February, 2022 has approved the proposal for elevation of the following advocates as judges in the Bombay High Court: Kishore Chandrakant Sant, Valmiki Menezes SA, Kamal Rashmi Khata, Sharmila Uttamrao Deshmukh, Arun Ramnath Pednekar, Sandeep Vishnupant Marne, Gauri Vinod Godse, Rajesh Shantaram Patil, Arif Saleh Doctor, and Somasekhar Sundaresan.”

In another statement, the top court said: “The Supreme Court Collegium in its meeting held on 16th February, 2022 has approved the proposal for elevation of the following advocates as judges in the Madras High Court: Nidumolu Mala, Sunder Mohan, Kabali Kumaresh Babu, S. Sounthar, Abdul Ghani Abdul Hameed, and R. John Sathyan.”

The top court collegium approved the proposal for appointment of Justice Ahanthem Bimol Singh, additional judge of the Manipur High Court, as permanent judge of that high court.

Recently, the Centre had notified the appointment of Acting Chief Justice Munishwar Nath Bhandari as Chief Justice of the Madras High Court.

The notification, published on the website of the Ministry of Law and Justice, said: “In exercise of the powers conferred by clause (1) of Article 217 of the Constitution of India, the President is pleased to appoint Justice Munishwar Nath Bhandari, Judge of the Madras High Court, to be the Chief Justice of Madras High Court with effect from the date he assumes charge of his office.”

In January, the Supreme Court Collegium, which is headed by Chief Justice N.V. Ramana, in a statement, said: “The Supreme Court Collegium in its meeting held on December 14, 2021/ January 29, 2022 has recommended elevation of Mr Justice Munishwar Nath Bhandari, Judge, Madras High Court (PHC: Rajasthan) as Chief Justice of Madras High Court”.

In another decision, the Centre also notified the appointment of the seven advocates as judges in the Andhra Pradesh High Court: Konakanti Sreenivasa Reddy @Srinivasa Reddy, Gannamaneni Ramakrishna Prasad, Venkateswarlu Nimmagadda, Tarlada Rajasekhar Rao, Satti Subba Reddy, Ravi Cheemalapati, and Vaddiboyana Sujatha.

The Centre also notified the appointment of three advocates as judges in the Madhya Pradesh High Court: Maninder Singh Bhatti, Dwarka Dhish Bansal @ DD Bansal, and Milind Ramesh Phadke, as well as three judicial officers: Amar Nath Kesharwani, Prakash Chandra Gupta, and Dinesh Kumar Paliwal.

The Central government also notified the appointment of the following advocates as Judges in the Orissa High Court: V. Narasingh, Biraja Prasanna Satapathy, and Sri Raman Murahari @ M.S. Raman.
