MEA Initiates Law Commission Inquiry into NRI Marriages

The Ministry of External Affairs (MEA) sought the Law Commission of India to examine the issue of Non-Resident of India (NRI) marriages and strengthen its framework in regard to international public law and also private laws.

According to the sources, the MEA has recently sent references in this regard to the Law Commission to examine the lacunae in present concerned laws which lead to problems like abandoning partners especially brides in NRI marriages.

The Law Commission is at the initial stage and is examining a structural framework to deal with the issue, according to sources.
As per the Law Commission, it will also look at international public law and private laws. What is required is to ensure that the prevention of lacunas that are benefiting the violators should be properly addressed. Also how the various procedural requirements of the court can be done.
The Commission would also be looking into the 2019 bill on the registration of marriages of NRI and the Foreign Marriage Act.

According to the MEA, it has received a large number of complaints pertaining to marital issues from Indian women married to overseas Indians. Such cases include abandonment of wife in India, delays in sponsoring of visa by spouse, cases of spouse stopping all communications, harassment of women by husband and in-laws, ex-parte divorce by spouse etc. These cases often also include issues related to child custody.

According to the Ministry and the Missions/Posts provide appropriate counselling, guidance and information to the aggrieved Indian women about legal procedures & mechanisms in such cases. The Indian Missions and Posts also conduct walk-in sessions and open house meetings for the distressed Indians including women to address their grievances. Grievances are also addressed through MADAD and CPGRAM portals.

Further, Missions and Posts also maintain a 24×7 Helpline for emergency situations and assistance is also provided through social media platforms. Financial and legal assistance is provided under the Indian Community Welfare Fund (ICWF) to distressed NRI women, wherever applicable, said MEA. (ANI)

NRI Charged over $450K insider trading in the US

An Indian-origin partner in a global consulting firm has been arrested and charged in an alleged insider trading scheme that netted him about $450,000…reports Asian Lite News

“Puneet Dikshit has been charged with serious felonies for his alleged conduct” of exploiting insider information about a pending acquisition, New York Federal Prosecutor Damian Williams said on Wednesday.

He was produced before Federal Magistrate Judge Kevin Fox, who set a bail of $1 million.

NRI Charged over $450K insider trading in the US

According to a LinkedIn profile, he worked for McKinsey & Company, one of the largest global consulting firms.

Court papers said that Dikshit’s company had been hired by Goldman Sachs to advise it on the acquisition of GreenSky, a company traded on the NASDAQ stock exchange, and that he had used insider information to trade options on that company’s stocks.

After making some small trades, he bought call options – which are essentially bets on the stock prices going up – in accounts in his and his spouse’s name for about $24,647 about two days before the Goldman Sach’s announcement on September 15 that it was acquiring GreenSky in a $2.24 billion deal, according to court papers.

After the announcement when the stock prices shot up, he sold the call options at a profit of 1,829 per cent, netting about $450,000, court papers said.

“Dikshit now faces significant federal charges, which should serve as a warning to others considering similar conduct,” said Michael J. Driscoll, the assistant director of the Federal Bureau of Investigation.

Dikshit, 40, is facing two separate charges, each of which carries a maximum prison sentence of 20 years.

Besides the criminal case filed by the prosecutor, he is facing a civil case launched by the Securities and Exchange Commission seeking monetary penalties.

The lure of easy money from insider trading, using confidential information to manipulate stock prices or make a profit, has been the undoing of several leading figures in the US world, among them several people of Indian origin.

The most famous among them to get entangled in insider trading is Rajat Gupta, who was the first foreign-born person to head McKinsey.

He was sentenced to two years after being convicted of insider trading in 2012 and spent about a year and a half in prison and the rest of the term under house arrest.

Anil Kumar, a senior partner and director at McKinsey, who was involved in the same case turned approver and testified against Gupta. He was sentenced to two years of probation.

Oxygen appeal for Corona crippled India. The British Asian Trust (BAT), a Prince of Wales’ Charity, has launched an emergency appeal ‘Oxygen For India’ to aid the deepening Covid-19 crisis in India. Rates of Covid-19 cases and deaths in India are rising at a hugely alarming pace, with India setting new world records for the daily rise in number of cases.

India’s hospitals are overrun, have stopped admitting patients and are running low on vital supplies and equipment including oxygen, leaving people helpless as they watch their loved ones die on stretchers outside the hospital doors.

British Asian Trust’s ‘Oxygen For India’ emergency appeal will raise funds for oxygen concentrators, and together with local partners in India, will rapidly deploy them to the hospitals and patients that need them most. Having consulted with the Indian and UK governments, the British Asian Trust’s advisors and programme partners in India have outlined a package of support that will compliment what industry, government and other charities are doing to help.

All funds raised by the ‘Oxygen For India’ emergency appeal will go towards providing as many oxygen concentrators to hospitals as quickly as possible. Oxygen concentrators are alternate devices to oxygen cylinders – while cylinders contain a finite amount of oxygen supply, a concentrator continually recycles oxygen from the air and delivers it to the patient.

A donation of £50 will provide oxygen for 40 patients struggling to breathe, £450 will provide low-flow oxygen concentrator to help 900 patients and an £830 donation will provide high-flow oxygen concentrator to help 550 of the most seriously ill patients.

 “We have seen the terrible impact of the pandemic worldwide but the devastation in India currently is one of the worst points of the last 12 months,” said Hitan Mehta, Executive Director, British Asian Trust. “The astronomical numbers of Covid-19 cases and deaths in India are frightening and we fear there is still a peak to come. What we can do now is provide essential support as quickly as possible to help those most in need. Our ‘Oxygen For India’ emergency appeal has been set up to provide vital supplies and equipment to save lives. We simply cannot stand by and do nothing.”
