EU sues Poland over court rulings

The European Union (EU) is to take legal action against Poland for violating EU law and compromising judicial independence, its executive has announced.

The action is an escalation of a rule-of-law wrangle between Brussels and Warsaw over rulings made by Poland’s top court, which this year found key elements of EU law to be incompatible with the country’s constitution, Xinhua news agency reported.

The European Commission announced in a statement it was taking action over “serious concerns” regarding the rulings by the Polish Constitutional Tribunal in July and October. These rulings “expressly” challenged the primacy of EU law, the Commission said, adding that Poland now has two months to respond to the complaint.

The Commission has “serious doubts about the independence and impartiality” of Poland’s Constitutional Tribunal, which “no longer meets the requirements of a tribunal previously established by law.”

Brussels can bring infringement procedures against member states when they do not respect or fully implement EU laws. The first step is an exchange of letters, but cases can be taken before the European Court of Justice (ECJ) and result in financial penalties.

The ECJ had previously ruled against Poland’s lifting of the immunity of certain judges, and dismissing of those deemed unacceptable by the parliament.

The Commission is also dissatisfied with a 2019 Polish law prohibiting the country’s courts from interpreting some areas of EU law, and from submitting legal matters to the ECJ.

“We’ve tried to engage in a dialogue but the situation is not improving,” the EU’s Justice Commissioner Didier Reynders posted on Twitter. “Fundamentals of the EU legal order, notably the primacy of EU law, must be respected.”

Russia has clear responsibility in Belarus-Poland border crisis: Truss

According to The Telegraph, UK officials fear that the migrant crisis at the Polish border could soon reach closer to the United Kingdom…reports Asian Lite News.

British Foreign Secretary Liz Truss has accused Moscow of bearing responsibility for the migrant crisis on the Belarusian-Polish border.

“Russia has a clear responsibility here. It must press the Belarusian authorities to end the crisis and enter into dialogue,” Truss said in her article published by The Telegraph on Saturday.

She accused Minsk of using migrants “as pawns” and of undermining regional security.

“We are not just standing side by side with Poland as it bears the brunt of this shameful manufactured migrant crisis, but also the others in the Visegrad Four – Hungary, Slovakia and the Czech Republic – and our friends in the Baltics and Ukraine,” Truss said.

According to The Telegraph, UK officials fear that the migrant crisis at the Polish border could soon reach closer to the United Kingdom.

On Saturday, EU foreign policy chief Josep Borrell discussed the situation on the Belarusian-Polish border with the foreign ministers of Poland and Lithuania and said that the issue will also be brought up at the EU Foreign Affairs Council (FAC) next week.

Belarusian Deputy Foreign Minister Sergei Aleinik said on Saturday that Minsk does not see the European Union making any serious efforts to hold dialogue with Belarus to resolve the ongoing migrant crisis.

Poland, Lithuania and Latvia have been accusing Belarus of orchestrating a migrant crisis to get back at Brussels for sanctions against the government of President Alexander Lukashenko. The Belarusian leader has rejected the accusations, saying that his cash-strapped country can no longer afford tight border controls.

Kremlin spokesman Dmitry Peskov said on Thursday that Russia is not involved in the migration crisis on the border between Belarus and Poland, and that Moscow is making attempts to assist conflict resolution through contacts with authorities. (ANI/Sputnik)

Poland, Lithuania, Latvia discuss possible NATO meeting

Poland is discussing the option of convening the North Atlantic Council with Lithuania and Latvia over the situation with migrants at the border with Belarus, Polish Prime Minister Mateusz Morawiecki told media on Sunday.

“We discuss with Latvia and, especially, with Lithuania, why do not we use the NATO Article 4,” Morawiecki told the Polish PAP press agency.

Article 4 of the NATO treaty entails the possibility of convening the North Atlantic Council if there is a threat to the security of one of the member countries. (ANI/Sputnik)
